When dismissal without cause occurs, the employer must pay a 40% fine over the full FGTS balance at the date of dismissal. The government also charges an additional 10% contribution, but this goes to a fund and is not paid to the worker.
Severance Pay Calculator (Brazil)
Simulate CLT severance amounts based on dismissal type.
What changes in severance according to the dismissal type.
CLT severance varies according to how the employment relationship ends. Dismissal without cause entitles the worker to: prior notice, proportional 13th salary, proportional vacation, overdue vacation + 1/3, FGTS withdrawal and 40% FGTS fine. For-cause dismissal removes most rights. Resignation eliminates the FGTS fine and prior notice. Mutual agreement (art. 484-A) allows a 20% FGTS fine and 50% prior notice. This tool simulates each scenario.
